Please read these Terms of Service carefully before using Waxd. By creating an account or using the app, you agree to these terms. If you don't agree, do not use Waxd.
Apple Notice: These Terms of Service are between you and Waxd only — not Apple Inc. Apple is not a party to this agreement and has no obligation to provide maintenance, support, or warranty for Waxd. Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms and have the right to enforce them against you.
By downloading, installing, or using the Waxd application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all users of the App, including listeners and artists. If you are using Waxd on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You must be at least 13 years old to use Waxd. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. Waxd is not directed at children under 13, and we do not knowingly collect data from children under 13.
You also represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
Waxd grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, solely for your personal, non-commercial use in accordance with these Terms and Apple's App Store Terms of Service.
This license does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, redistribute, or sublicense the App.
Family Sharing and Apple's Volume Purchase Program are permitted where supported.

We reserve the right to suspend or permanently ban accounts that violate these rules, at our sole discretion, with or without prior notice.
Artists may submit tracks to the Waxd feed by providing an Apple Music link. By submitting a track, you represent and warrant that:
Waxd does not host audio files. Music previews are served directly through Apple's iTunes API. We are not responsible for the availability, accuracy, or content of previews served by Apple.
Waxd reserves the right to remove any submission at any time for any reason, including but not limited to violations of these Terms or applicable law.
Waxd uses Apple's free iTunes Search and Lookup API to retrieve 30-second music previews and track metadata. Use of these previews within Waxd is subject to Apple's Media Services Terms and Conditions. Nothing in these Terms grants you any rights beyond those provided by Apple for the use of such preview content.
Waxd and its original content, features, and functionality — including the name, logo, design, XP system, and gamification mechanics — are owned by Waxd and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our App or content without our written permission.
Music content available through Apple Music previews belongs to the respective rights holders. Waxd makes no claim of ownership over any music streamed through the App.
User-generated content (profile information, reactions) remains yours. By using Waxd, you grant us a limited, worldwide, royalty-free license to display and use your public profile information and reactions within the App to operate its features.
Waxd is currently in beta. The App is provided as-is and may contain bugs, errors, or incomplete features. We make no guarantees about uptime, data persistence, or feature availability. Features may be changed, added, or removed at any time without notice. We are not liable for any loss of data or progress (XP, streaks, level) that results from downtime, bugs, or service changes during the beta period.
Waxd is solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Waxd. Any questions or complaints about the App should be directed to us at hello@waxd.io, not to Apple.
To the maximum extent permitted by applicable law, Waxd is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App.
To the maximum extent permitted by applicable law, Waxd and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of XP or streaks, loss of profits, or loss of goodwill, arising out of or in connection with your use of the App. Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed $100 USD.
Waxd accepts responsibility for any product liability claims, legal compliance claims, and claims under consumer protection or similar legislation relating to the App, to the extent required by applicable law.
Waxd is solely responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claims relating to the App or your use of it. If you believe any content in the App infringes your intellectual property rights, please contact us at hello@waxd.io.
You may stop using Waxd at any time and delete your account via Profile → Settings → Delete Account.
We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in conduct we deem harmful to users or the platform, or for any other reason at our discretion. Upon termination, your license to use the App ceases immediately.
These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the applicable courts. You agree to submit to the personal jurisdiction of such courts.
We may update these Terms from time to time. We will update the effective date at the top of this page when we do. For material changes, we may notify you within the App. Your continued use of Waxd after any changes constitutes your acceptance of the new Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.
